Identity of the Data Controller

Data source and type of data collected:
1) Data communicated by the user
Ormant s.r.l. collects personal data that is voluntarily provided by users when sending a message using the form provided or the contact addresses on the site www.agriormant.it. The optional, explicit and voluntary transmission of messages to the contact addresses as well as the filling out and forwarding of the forms present on the site, involve the acquisition of the contact details of the sender, necessary to provide feedback, as well as all personal data included in the communications.
The data provided will be processed with IT and electronic transmission tools for the sole purpose of providing the requested service and for this reason they will be retained exclusively for the period in which the same is active.
2) Navigation data
Ormant s.r.l. also collects data relating to the use of the website by the user. This information is acquired by computer systems and software procedures used to operate the online portal, during their normal operation. Moreover, the transmission of the same is connected to and inherent in the use of Internet communication protocols.
This category of data includes the IP addresses or domain names of the computers and terminals used by the users, the URI/URL (Uniform Resource Identifier/Locator) notation addresses of the required resources, the time of the request, the method used to submit the request to the server, the size of the file obtained in response, the numeric code indicating the status of the response given by the server and other parameters related to the operating system and to the IT environment of the user.
This data, necessary for the use of web services, is also processed for the purpose of:
Obtaining statistical information on the use of services (most visited pages, number of visitors by time or day, geographical areas of origin, etc.).
Checking the correct operation of the services offered.
The navigation data does not persist for more than seven days and is cancelled immediately after their aggregation (except for any need for the investigation of crimes by the Judicial Authority).
3) Cookies and other tracking systems
In order to make its services as efficient and simple to use as possible, this site uses cookies. Therefore, when visiting the Site, a minimum amount of information is entered into the User’s device, such as small text files called “cookies”, which are saved in the User’s web browser directory. Processing purposes
Depending on the type of processing to be carried out, the personal data of the data subject may be processed:
1) To provide feedback regarding any communications, requests for information and/or services from users through the specific form or using the address/es in the contact section.
2) For marketing and commercial promotion purposes, for surveys and market research with regards to Services/Products that the Data Controller offers. This processing can be done in an automated way, with the following methods: email, text messages, telephone contact. It can be carried out if the data subject has not revoked his/her consent to the use of the data.
3) Finally, the data will be used to manage and control risks, prevent and manage potential disputes, and take legal action in case of need.
Purpose and legal basis of the processing
With reference to the purposes indicated in the previous paragraph, the legal basis of the same is, with respect to point:
1) The execution of a contract of which the data subject is a party or execution of pre-contractual provisions adopted upon request of the same.
2) The consent given by the data subject.
3) The need to pursue the legitimate interest of the data controller (in particular with regard to fraud prevention).
Data recipients
The personal data processed by the Data Controller is not disseminated, i.e. is not disclosed to undetermined subjects, in no possible form, including that of making it available for use or simple viewing.
However, data can be communicated to workers who are employed by the Data Controller, or to subjects authorised to process data as under the authority of the Data Controller. The processing by these subjects will occur according to roles and responsibilities, taking into account the respective competences and in accordance with the instructions given to them by the Data Controller.
In this regard, (Company name), has commissioned third party service providers with respect to the operation of the website, such as hosting service providers, marketing service providers and websites, IT maintenance service providers, VAT verification services, and service providers who allow the integration on the website of other functions that users can use at their discretion.
These service providers, designated as external data processors, only receive the personal data necessary to provide the corresponding services and they are not allowed to use or disclose the personal data of the data subjects for other purposes, without prior authorisation of the data subject.
Finally, the data can be communicated to the subjects entitled to access it under the provisions of the law, regulations and Community legislation.
Data transfers
In no case will the Data Controller transfer personal data to third countries or international organisations.
However, it reserves the right to use cloud services; in which case, the service providers will be selected from those who provide adequate guarantees, as required by art. 46 GDPR 679/16.
Data retention
The Data Controller maintains and processes personal data for the time necessary to fulfil the indicated purposes. Subsequently, the personal data will be stored and not further processed, for the time established by the current legal provisions.
In the case of data supplied for purposes of commercial promotion for services other than those already acquired from the data subject, for which s/he has initially given consent, these will be retained for 24 months, unless the consent is revoked.
It should also be added that, in the event that a user provides the Data Controller with unsolicited or unnecessary personal data for the purpose of performing the requested service or for the provision of a service closely connected to it, Ormant s.r.l. cannot be considered the controller of this data and will provide for its cancellation as soon as possible.
Rights of the data subject
In relation to the processed data referred to in this information notice, the data subject has, at any moment, the right to:
Ask the Data Controller to access his/her personal data and information relating to them (art. 15 of the GDPR); the rectification of inaccurate data or the integration of incomplete ones (art. 16 of the GDPR); the cancellation of personal data (if one of the conditions indicated in art. 17, par. 1 of the GDPR apply and in compliance with the exceptions provided in paragraph 3 of the same article); the limitation of the processing of personal data (in the event of one of the hypotheses indicated in art. 18, par. 1 of the GDPR).
Request and obtain from the Data Controller – in cases where the legal basis for processing is consent and the same is carried out by automated means – his/her personal data in a structured and machine-readable format, also for the purpose of communicating such data to another data controller (so-called right to the portability of personal data – art. 20 of the GDPR).
Oppose the processing of personal data at any time in the event of particular situations (art. 21 of the GDPR).
Withdraw his/her consent at any time, limited to cases where the processing is based on consent for one or more specific purposes. The processing based on consent and carried out prior to the revocation of the same retains, however, its lawfulness (7, par. 3, of the GDPR).

If the data subject considers that the processing of his/her data is in violation of the provisions of the Privacy Regulation, the same may lodge a complaint with a supervisory authority (Privacy Authority – www.garanteprivacy.it), as required by art. 77 of the GDPR, or initiate the appropriate legal action (art. 79 of the GDPR).
Refusal to provide data
Refusal to provide the data necessary for registration on the site will prevent the transaction from ending successfully. The additional data indicated in point a) of the paragraph “Data source and type of data collected”, which is not mandatory for registration purposes, is provided on a voluntary basis. However, if the data subject decides not to provide the requested data, Ormant s.r.l. may not be able to provide certain services. The data indicated in point b) is provided voluntarily by the data subject and should the same decide not to provide the requested data, the functions and/or services offered through the site could be compromised in their usability.

The Data Controller does not carry out processing consisting of automated decision-making processes on the data of individuals.

What are cookies?
Cookies are pieces of information entered on your browser when you visit a website or use a social network with your PC, smartphone or tablet. Each cookie contains various data such as, for example, the name of the server from which it comes, a numeric identifier, etc.

Cookies and privacy
Given the particular invasiveness that profiling cookies (especially third-party cookies) may have in the private sphere of users, European and Italian legislation establish that users must be adequately informed about their use and express their valid consent to insert cookies on their terminal.

Activating the Do Not Track option

Activating the “anonymous surfing” mode
With this function it is possible to navigate without leaving a trace in the browser regrading the navigation data. The sites will not remember the user, the pages visited will not be stored in the history and new cookies will be deleted.
However, the anonymous browsing function does not guarantee anonymity on the Internet, because its only aim is not maintaining the navigation data in the browser, while your browsing data will continue to remain available to website managers and connectivity providers.
